Flashette Terms of Use

These Terms of Use (the "Terms") are a legally binding agreement between you and the operator of Flashette ("Flashette", "we", "us" or "our"). They govern your access to and use of the Flashette mobile application (the "App"), the website at flashette.com (the "Site"), and any related features, content, purchases and services (together, the "Service"). Please read them carefully.

Summary, not a substitute for the full Terms: Flashette creates AI edits of your photos. Edits are artistic changes, not real records, and AI can make mistakes. Subscriptions renew automatically through Apple until you cancel. Purchases are billed and refunded by Apple. Only upload photos of yourself, or of people who have given you permission. Section 18 and Section 19 limit our liability.

1. Agreement to these Terms

By downloading, installing, accessing or using the Service, or by making a purchase in the App, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

If you use the Service on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf, and "you" refers to both you and that person or organization.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, or under the age of legal majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use, including any purchases.

You may not use the Service if you are barred from doing so under the laws of the United States or any other applicable jurisdiction, or if we have previously terminated your access.

3. The Service

Flashette is an AI photo and video editor. Depending on the features available to you, the Service lets you:

• AI looks: restyle a photo in a chosen look, such as digicam flash, film, golden hour, photobooth or a new setting, while keeping the person recognizable.
• Videos: turn a finished AI look into a short video clip with a chosen motion.
• Free editor: apply tints, flash glow, vignette and a date stamp on your device, without AI and without credits.
• Adjust the strength of an edit, save edits to your device and share them.

Each AI photo or video you create is an "edit" and uses credits as described in Section 6. Features, looks, prices and credit costs may change over time as described in Section 16.

4. Your account

Flashette works without a sign-up form. When you first open the App, we set up a private account for you on your device, so you can start right away without giving us an email address or password. Your edits, weekly credits and credit pack balance belong to that account.

Sign in with Apple. You can choose to sign in with Apple at any time, for example under You in the App. This backs up your account so you can get it back on a new or reset device by signing in with the same Apple ID. We receive only a unique identifier from Apple; we do not request your name or email address. If you sign in on a device where you have already used Flashette without signing in, the edits and credits from that device are added to your existing account.

• You are responsible for all activity that happens through your device and account, and for keeping your device and Apple ID secure.
• If you have not signed in with Apple and you delete the App, reset or lose your device, we may be unable to recover your edits or any unused credit pack balance. Active subscriptions can always be restored with Restore purchases in the App while signed in to the same Apple ID.
• Signing out of Flashette keeps your account backed up. Deleting your account, as described in Section 17, removes it permanently and disconnects Sign in with Apple.
• Any information you provide, such as an optional first name or onboarding answers, must be accurate and must not infringe anyone's rights.
• Accounts are personal. You may not sell, transfer or share your account or its credit balance.

5. Subscriptions and billing

Flashette Pro is an auto-renewing subscription available on the plans shown in the App. The price, billing period and currency of each plan are shown in the App before you confirm your purchase and may vary by country. Unless stated otherwise in the App, Flashette Pro includes the number of weekly credits shown in the App, in any rolling seven-day period, together with the other features we describe as part of Pro.

• Payment. All purchases in the App are processed by Apple through your Apple ID. Payment is charged to your Apple ID account when you confirm the purchase.
• Automatic renewal. Your subscription renews automatically for the same period at the then current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Managing and cancelling. You can manage or cancel your subscription at any time in your Apple ID account settings (on iPhone: Settings, your name, Subscriptions). Deleting the App or your Flashette account does not cancel a subscription. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
• Free trials and offers. If we offer a free trial or introductory price, its terms are shown before purchase. Any unused portion of a free trial is forfeited when you purchase a subscription, where Apple applies that rule.
• Price changes. We may change subscription prices. Apple will notify you in advance as required, and where required by law or Apple's rules, will ask for your consent before a price increase applies to you. If you do not agree to a price change, you may cancel before it takes effect.
• Taxes. Prices may include or be subject to taxes as determined by Apple and applicable law.

6. Credits

• What credits are. AI edits use credits. The number of credits each kind of edit uses (for example one for a photo look and more for a video) is shown in the App before you create it.
• Weekly credits. Flashette Pro includes a number of credits in any rolling seven-day period, shown in the App. Unused weekly credits do not roll over, have no cash value and end when your subscription ends.
• Credit packs. Credit packs are one-time, non-renewing purchases of a set number of credits. You do not need a subscription to buy or use them. They do not expire while your account exists, are used only after any available weekly credits, and are not transferable between accounts.
• No cash value. Credits are a limited license to use a feature of the Service. They are not property, have no monetary value, and cannot be exchanged for cash, sold or transferred, except where the law requires otherwise.
• Failed edits. If an edit fails for technical reasons, it does not count against your weekly credits and any credits from a pack are returned to your balance.
• Fair use. To protect the Service, we apply reasonable rate limits, such as a short pause after many edits in a row, and may limit or suspend use where we reasonably suspect automated use, abuse or fraud.

7. Cancellations and refunds

Because Apple processes all App purchases, we cannot issue refunds directly and do not have access to your payment details. To request a refund, visitreportaproblem.apple.com. Refund decisions are made by Apple under its policies. Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial subscription periods, unused credits or unused credit pack balances.

If you live in a country that gives consumers a statutory right to withdraw from or cancel a purchase, nothing in these Terms limits that right. Where you request immediate access to digital content, you may lose that right once the content has been supplied, to the extent permitted by law.

8. Your photos and content

"Your Content" means the photos you submit and the edits created from them. As between you and us, you own Your Content, including the edits created for you, to the extent the law allows ownership of AI generated output.

You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit and display Your Content solely as needed to operate and provide the Service to you, including sending photos to the third-party AI provider described in Section 14 and our Privacy Policy. We do not use your photos for advertising, we do not sell them, and we do not use them to train AI models.

How photos are handled. Before your first AI edit, the App asks for your permission to send your photo to a third-party AI service. Flashette does not store the photo you upload; we keep a link to the finished edit so it appears in your gallery. The free editor runs only on your device. See our Privacy Policy for details.

You represent and warrant that:

• any photo of a person that you submit is of yourself, or you have that person's permission to submit and edit it;
• you do not submit photos of anyone under 18;
• you have the rights needed to submit each photo, and doing so does not infringe any copyright, trademark, privacy, publicity or other right; and
• Your Content and the way you use edits do not violate these Terms or any law.

When you share an edit outside the App, you choose who sees it, and that sharing is governed by the terms of the service you share it through. Do not present an edit of another person as a real, unedited photo in a way that could mislead or harm them.

9. AI generated edits

Edits are generated automatically by artificial intelligence models and are provided for creative and entertainment purposes. You acknowledge that:

• Edits are artistic changes. They change light, color, camera feel, setting and motion. They are not a realistic record of a real moment or place.
• Results vary. AI can make mistakes, change details you did not expect, or produce a result you do not like. Different photos, or the same photo edited twice, may give different results.
• Likeness. We design every look to keep the person recognizable, but AI may change small details of a face, body, hair or clothing.
• You decide what to do with them. You are responsible for how you use and share edits, including telling others that an image or video was edited with AI where the law or a platform's rules require it.

10. AI labels

Some platforms and laws require AI generated or AI edited images and videos to be labeled. When you post an edit, follow the rules of the platform you post to and the law that applies to you.

11. Acceptable use

You agree not to, and not to help anyone else to:

• submit photos of another person without their permission, or photos of anyone under 18;
• create sexually explicit, nude, violent, hateful, harassing or unlawful content, or content that exploits or endangers minors;
• create deceptive images or videos of real people, such as fake evidence, impersonation, or edits meant to embarrass, defame or harass someone;
• use the Service to identify, track, profile, rate or shame any person;
• copy, scrape or extract data or content from the Service by automated means, or use it to build or train a competing product or AI model;
• reverse engineer, decompile or attempt to derive the source code, models, prompts or underlying structure of the Service, except where the law expressly permits it;
• bypass or interfere with security features, credit limits, rate limits, purchase verification or other technical protections;
• access the Service through any interface other than the App or Site, or use bots or scripts to create accounts or edits;
• resell or commercially exploit the Service without our written permission; or
• use the Service in violation of any applicable law or regulation, or of Apple's App Store terms.

12. Our intellectual property

The Service, including the App, the Site, software, design, text, color palettes, guides, articles, graphics, logos, the Flashette name and all related content (other than Your Content) is owned by us or our licensors and is protected by copyright, trademark and other laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the App on Apple devices that you own or control, and to use the Service, for your personal, non-commercial purposes.

You may save and share your own edits for personal, non-commercial purposes. All rights not expressly granted to you are reserved. You may not use our name, logos or trademarks without our prior written consent.

13. Feedback

If you send us ideas, suggestions or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it for any purpose without obligation or compensation to you. You are not required to send feedback.

14. Third-party services

The Service relies on third parties, including:

• Apple, which distributes the App and processes all in-app payments and refunds;
• RevenueCat, which helps us verify purchases and manage subscription status;
• fal.ai, which runs the AI models that create your edits from the photos you submit;
• PostHog, which receives app usage analytics as described in our Privacy Policy; and
• hosting, infrastructure and privacy-friendly website analytics providers (such as Vercel) that help us operate the Service.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party websites, services or content that we link to or that you choose to use, and a link does not mean we endorse them.

15. Privacy

Our Privacy Policy explains what information we collect, how we use it, and your choices, including how to delete your account and data. By using the Service, you acknowledge that we will process information as described there.

16. Changes and availability

We are continually improving the Service. We may add, change, limit or remove features, looks, content, AI models or providers, and may release updates that you must install to keep using the App. We will try to give reasonable notice of changes that materially reduce what you have paid for. The Service may occasionally be unavailable because of maintenance, outages at our providers or events outside our control, and we do not guarantee that it will be available at all times or in every country.

17. Suspension, termination and deletion

By you. You may stop using the Service at any time. You can permanently delete your account and its data in the App underYou, then Delete account. Deletion removes your account, your edit history and any unused credit pack balance, revokes Flashette's access to your Sign in with Apple credentials, and cannot be undone. Remember to cancel any subscription separately in your Apple ID settings.

By us. We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms, created risk or legal exposure for us, other users or third parties, or engaged in fraud or abuse, or if we are required to do so by law. We may also discontinue the Service entirely; if we do, we will give reasonable advance notice where possible.

Sections that by their nature should survive termination, including Sections 6 (no cash value), 8 (your warranties), 9, 10, 12, 13 and 18 through 23, will survive.

18. Disclaimers

To the fullest extent permitted by law, the Service and all results, content and information are provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or quiet enjoyment, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure or error-free, that results will be accurate, reliable or suited to you, or that any defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing in these Terms excludes rights you have as a consumer that cannot lawfully be excluded.

19. Limitation of liability

To the fullest extent permitted by law, in no event will Flashette, its operator, affiliates, licensors or service providers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, or for the cost of products purchased in reliance on any result, arising out of or relating to the Service or these Terms, whether based on warranty, contract, tort (including negligence), statute or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid for the Service in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (US$50).

These limitations apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not fully apply to you. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Flashette and its operator, affiliates, licensors and service providers from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or related to (a) Your Content, including any photo you submit of another person, (b) your use or misuse of the Service, or (c) your violation of these Terms, any law or the rights of any third party.

21. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first. Before filing any claim, you agree to contact us at support@flashette.com with a description of the dispute and try in good faith to resolve it informally for at least 30 days.

Courts. If a dispute is not resolved informally, it will be brought exclusively in the state or federal courts located in New York County, New York, and you and we consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court where it qualifies. If you are a consumer living outside the United States, you may also have the right to bring proceedings in the courts of the country where you live, and nothing in these Terms deprives you of the protection of the mandatory consumer laws of that country.

To the extent permitted by law, any claim must be brought within one year after the claim arises, and all claims will be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

22. Apple App Store terms

If you downloaded the App from Apple's App Store, the following additional terms apply, and prevail over anything inconsistent in these Terms:

1. Acknowledgement. These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
2. Scope of license. Your license to use the App is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing where available.
3. Maintenance and support. We are solely responsible for providing maintenance and support for the App as described in these Terms or required by law. Apple has no obligation to furnish any maintenance or support services for the App.
4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our responsibility, to the extent not disclaimed.
5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy or similar legislation.
6. Intellectual property rights. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer contact. Questions, complaints or claims about the App should be directed to us using the details in Section 25.
9. Third-party terms. You must comply with applicable third-party terms of agreement when using the App.
10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

23. General terms

• Entire agreement. These Terms, together with the Privacy Policy and any terms shown at the point of purchase, are the entire agreement between you and us about the Service.
• Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full effect.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our consent. We may assign them, for example in connection with a merger, acquisition or sale of assets.
• Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages of third-party providers.
• Export. You may not use or export the App except as authorized by U.S. law and the laws of the jurisdiction where you obtained it.
• Notices. We may give you notices within the App or on the Site. You may give us notice at the contact details below.
• Language. These Terms are written in English. Any translation is for convenience, and the English version controls to the extent permitted by law.
• Headings. Headings and the summary at the top are for convenience only and do not affect interpretation.

24. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Service or the law. We will post the updated Terms on this page and change the "last updated" date above. If a change is material, we will provide reasonable notice, such as a notice in the App, before it takes effect. By continuing to use the Service after the updated Terms take effect, you agree to them. If you do not agree, you must stop using the Service and cancel any subscription.
